EIA is required if the proposed project is stipulated under the Environmental Quality (Prescribed Activities) (Environmental Impact Assessment) Order 2015.
Sabah and Sarawak have implemented environmental legislation at the state level that subjects certain activities to the requirement of an EIA under state jurisdiction. List of prescribed activity subject to EIA in Sabah and Sarawak are described in Environmental Protection (Prescribed Activity) (Environmental Impact Assessment) Order 2005 and The Natural Resources and Environment (Prescribed Activities) Order 1994 respectively.

The EIA and EMP report must be prepared by EIA Consultant registered with DOE through Malaysian Certified Environmental Practitioner (myCEP) system. The list of registered EIA Consultants along with their contact details is maintained by DOE (https://mycep.doe.gov.my).

Project Proponent must ensure the concept of proposed project does not contradict any development plans, and national and state policies. Project proponent can refer to National Physical Plan, Structure Plan, Local Plan, and Regional Plan and other relevant policies to ensure project is compatible.

No. According to Section 34A (3), DOE only approves the EIA report. Project approval is granted by the approving authority such as state governments authorities and local authorities.
